jurisprud\u00eancia publicada, com impacto no setor segurador:<\/p>\n<p style=\"font-weight: 400;\">\n<p style=\"font-weight: 400;\">A presta\u00e7\u00e3o suplementar para assist\u00eancia a terceira pessoa, prevista no artigo 53.\u00ba da Lei de Acidentes de Trabalho (<a href=\"https:\/\/diariodarepublica.pt\/dr\/legislacao-consolidada\/lei\/2009-58661980\">Lei n.\u00ba 98\/2009, de 04\/09<\/a> \u2013 LAT) destina-se a compensar os encargos com assist\u00eancia de terceira pessoa quando o sinistrado se encontra, ou venha a encontrar, em situa\u00e7\u00e3o de depend\u00eancia devido a incapacidade permanente para o trabalho.<\/p>\n<p style=\"font-weight: 400;\">O valor m\u00e1ximo da presta\u00e7\u00e3o suplementar estava limitado a 1,1 do valor do Indexante de Apoios Sociais<a href=\"applewebdata:\/\/3ADEE803-FB40-49C1-97EB-62DEE511F16B#_ftn1\" name=\"_ftnref1\"><sup>[1]<\/sup><\/a>, nos termos do artigo 54.\u00ba, n.\u00ba 1, da LAT.<\/p>\n<p style=\"font-weight: 400;\">Contudo, o Tribunal Constitucional, no <a href=\"https:\/\/diariodarepublica.pt\/dr\/detalhe\/acordao-tribunal-constitucional\/380-2024-867844485\">Ac\u00f3rd\u00e3o n.\u00ba 380\/2024, de 04\/06<\/a>, declarou a inconstitucionalidade com for\u00e7a obrigat\u00f3ria geral desta norma, na medida em que permite que o limite m\u00e1ximo da presta\u00e7\u00e3o suplementar para assist\u00eancia de terceira pessoa seja inferior ao valor da retribui\u00e7\u00e3o m\u00ednima mensal garantida<a href=\"applewebdata:\/\/3ADEE803-FB40-49C1-97EB-62DEE511F16B#_ftn2\" name=\"_ftnref2\"><sup>[2]<\/sup><\/a>.<\/p>\n<p style=\"font-weight: 400;\">Neste seguimento, foram tamb\u00e9m publicados dois Ac\u00f3rd\u00e3os do Tribunal da Rela\u00e7\u00e3o de Lisboa, j\u00e1 considerando o Ac\u00f3rd\u00e3o do Tribunal Constitucional que contribuem para clarificar o regime aplic\u00e1vel \u00e0 atualiza\u00e7\u00e3o da presta\u00e7\u00e3o suplementar<a href=\"applewebdata:\/\/3ADEE803-FB40-49C1-97EB-62DEE511F16B#_ftn3\" name=\"_ftnref3\"><sup>[3]<\/sup><\/a>. Nestes ac\u00f3rd\u00e3os esclarece-se que para acidentes de trabalho ocorridos a partir de 01 de janeiro de 2010, aplica-se a Lei n.\u00ba 98\/2009, sendo o limite m\u00e1ximo da presta\u00e7\u00e3o suplementar a retribui\u00e7\u00e3o m\u00ednima mensal garantida, ressalvados os casos julgados (de acordo com o artigo 282.\u00ba n.\u00ba 3 da Constitui\u00e7\u00e3o da Rep\u00fablica Portuguesa).
