2023, do Supremo Tribunal de Justi\u00e7a, relator M\u00e1rio Belo Morgado (Processo n.\u00ba 151\/21.8T8OAZ.P1.S1), com o seguinte sum\u00e1rio:<\/a><\/p>\n<p>\u201cI- A responsabilidade agravada do empregador pode ter dois fundamentos aut\u00f3nomos: um comportamento culposo da sua parte (a t\u00edtulo de dolo ou neglig\u00eancia), criador de uma situa\u00e7\u00e3o perigosa (e inerente\u00a0<em>esfera de risco<\/em>); ou a viola\u00e7\u00e3o pelo empregador de regras de seguran\u00e7a ou sa\u00fade no trabalho que ele estivesse diretamente obrigado a observar e de cuja omiss\u00e3o resulte o acidente (hip\u00f3tese em que \u00e9 desnecess\u00e1ria prova da culpa, ao contr\u00e1rio do que acontece naquele primeiro caso).<\/p>\n<p>II- Ambos os fundamentos exigem (para al\u00e9m do \u201ccomportamento culposo\u201d ou da viola\u00e7\u00e3o normativa) a prova do nexo causal entre determinada conduta (ato ou omiss\u00e3o) e o acidente.<\/p>\n<p>III- O \u00f3nus de alegar e provar os factos que agravam a responsabilidade do empregador compete ao respetivo benefici\u00e1rio, nos termos do artigo 342.\u00ba, n.\u00ba 1, do C\u00f3digo Civil.<\/p>\n<p>IV-\u00a0<em>In casu<\/em>\u00a0mostra-se violada uma regra de seguran\u00e7a espec\u00edfica e nitidamente densificada nos seus contornos, que \u00e9 poss\u00edvel enunciar da seguinte forma: sempre que se utilizem cavaletes durante a realiza\u00e7\u00e3o dos trabalhos de manuten\u00e7\u00e3o de moldes, dever\u00e1 ser assegurada a estabilidade destes, atrav\u00e9s de adequados dispositivos de seguran\u00e7a, que garantam que os moldes n\u00e3o tombam sobre os trabalhadores, mesmo em caso de rutura das soldas ou queda dos cavaletes, mediante, por exemplo, a fixa\u00e7\u00e3o do mesmo a uma cota mais elevada, prendendo-o atrav\u00e9s de um gancho.<\/p>\n<p>V- N\u00e3o fora a infra\u00e7\u00e3o desta regra, o acidente n\u00e3o se teria produzido.
